We have successfully represented clients in courts from the Supreme Court of the United States to the Davidson County Chancery Court, and before numerous federal, state, and local administrative bodies.  We are experienced in complex business, employment, securities, health care, and intellectual property litigation and arbitration, including class actions and nationwide disputes.  Kate Stephenson leads our litigation and arbitration practice.

Our attorneys have found solutions for start-ups and multinational corporations.  Bob Tuke is general counsel to a private medical college and a former board member and general counsel to the Nashville Chamber of Commerce.  Anne Arney and other partners have served as board members and senior corporate counsel to publicly- and privately-held companies in the health care and insurance sectors.

We assist health care clients in many ways to meet their missions and to protect and expand their businesses and practices.  We facilitate mergers, acquisitions, and divestitures, and help clients navigate federal and state regulations.  Byron Trauger has an active practice before the Tennessee Health Services and Development Agency, the Tennessee agency with jurisdiction over certificates of need.  Bob Tuke is general counsel to a private medical college.  Anne Arney served as senior corporate counsel to a health benefits company. As co-counsel for HCA, Inc., Kate Stephenson is defending a certificate of need granted by the Health Services Development Agency for the construction of a new hospital in Spring Hill, Tennessee. The certificate of need was upheld on administrative appeal. A further appeal by the two large hospitals who oppose HCA is pending in Chancery Court.

Many clients rely on our attorneys' extensive experience dealing with local, state, and federal governments. We have helped clients participate in the policymaking process, and we have represented clients before administrative decisionmakers. We have been effective in both roles.

Byron Trauger has substantial experience dealing with Tennessee state government and the Metropolitan Government of Nashville and Davidson County.  He has been active in Democratic politics for more than three decades.  Bob Tuke is the immediate past Chair of the Tennessee Democratic Party, has served as State Campaign Finance Chair for a United States Senate campaign, and is now a candidate for public office.  He has drafted, and shepherded through the state legislative process, family law reform legislation that is now a national model.

We also represent clients in a variety of administrative settings.  Byron Trauger has a substantial health care practice before the Tennessee state agency that issues certificates of need.  Others have represented clients before state and county boards of equalization, health-related boards, and other federal, state, and local administrative bodies.

In all of these contexts, we seek to combine our public service, business, and litigation experience to reach optimum solutions for our clients.

 
A L T E R N A T I V E    D I S P U T E    R E S O L U T I O N

Businesses are increasingly turning to alternatives to litigation to resolve disputes.  Mediation, arbitration, and other forms of dispute resolution are now firmly established in the business and legal cultures.  Trauger & Tuke is a leader in providing the full range of dispute resolution services.  Robert Brandt joined us in 1997 after a distinguished twenty-one year judicial career, and now is a full-time mediator and arbitrator.  He serves on the Employment and Commercial panels of the American Arbitration Association, the regional Distinguished Neutrals and national Entertainment Law panels of the CPR Institute for Dispute Resolution, and is a Fellow of the American College of Civil Trial Mediators.
